Maintenance can be awarded either on a temporary or permanent basis. Temporary maintenance, which goes into effect while the divorce proceedings are pending, may be awarded according to an income-based formula for lower income couples but may be subject to equitable principles for higher income couples.
Permanent maintenance may be determined according to a formulaic approach as well when the Colorado maintenance statutes currently in effect. However, judicial discretion may still be exercised in determining “fairness” by consideration of case specific factors, including:
